Harlequin Horse Racing Syndicates Terms and Conditions

These Terms and Conditions apply to all current Horse Racing Syndicates only.

  1. Ownership: By taking out a share in the Syndicate Horse you accept in full all these terms and conditions and agree to always comply with them and that you are aged over 18 years of age or older. Any disqualified persons from any Horse racing or Greyhound racing stadiums or racing syndicates are not welcome to purchase any Harlequin Racing Syndicate shares on offer. If you purchase a share and it is found out that you are a disqualified person, the share will be removed and placed for sale and no refund will be given.
  2. Use of Harlequin Horse Racing Syndicates: All confidential information MUST be used ONLY by the member whose name is entered in the registration form of the Horse. If the trainer of our Horse informs you personally of any information about the syndicate horse or other horses in their care this cannot be held against Harlequin Racing in any way shape of form. Harlequin Racing will brief the owners individually on the expected performance of the Horse in each race via the syndicated Horses What’s App group or the horses web space on www.harlequinsyndicates.co.uk.

3    PAST RESULTS: Members must be aware that not every Horse will win every race. Past results are not necessarily indicative of future performance of the Harlequin Horses.

  1. REFUNDS: Harlequin Horse Syndicates can not offer refunds of purchases under any circumstances. This is not through lack of goodwill but because we have fixed costs that are incurred, and we offer the Management service only and that the value of the Horse can fluctuate from one week to the next. Harlequin shall how ever do there best to sell on the share as a goodwill gesture.
  2. LIABILITY: Due to the nature of Racing, neither Harlequin Racing nor any of its Data Provided nor affiliates have any liability (whether in contract or tort) for any losses, costs or damages resulting from or related to use of or inability to use any information contained from our services or the provision of the services to the fullest extent to which such liability may be excluded or avoided by law. In no event shall Harlequin Racing be liable to you for perceived or actual lost profits or for indirect, incidental, special, punitive, or consequential damages arising out of or in relation to the provision of the services or the provision provided by Harlequin Racing.
  3. INDEMNITY: You irrevocably indemnify Harlequin Racing and its Data Providers and affiliates from and against any and all losses, damages and costs suffered or incurred by Harlequin Racing, any Data Providers or affiliates of whatsoever nature arising out of or in connection with your use, provision or distribution of information or any part of our services or any part or otherwise howsoever arising in relation to any breach of this agreement by you.
  4. Purchasing your share When you purchase your share of the syndicated Horse you are purchasing the ownership % of that Horse as stated at the point of sale. The initial charges are for the purchase of your share, and this remains your property until such time that a sale or an agreed relinquishment of the share takes place. The full cost details are fully explained on the For Sale post as are the Harlequin Management fees and as much detail as we know at the point of sale is made aware to the purchaser.
  5. Monthly Fees You are liable for your % share of each month’s Stable fee bills and additional costs that your syndicated horse may incur, except if the training fees are at an all in price. All possible charges are explained in the sale document of the horse. You are legally responsible for your horse for the length of the syndicate (1 year or the part of the year remaining) and you will be expected to pay the share of the stable fee bill that you incur within 7 days of the request from Harlequin Racing. Failure to pay the stable fees for 2 months will result in the share of the Horse being transferred to the ownership of Harlequin Racing without any refund or recompense to you the owner. The monies raised from this will go to paying the outstanding fees owed and fees incurred until the share is re sold. 2 Months missed Stable Fee bill payments terminates all ownership rights of the Horse.
  6. All Inclusive fees. Depending on which trainer we use for the horse we may have all inclusive training fees at a set price, there may be times when a vet is needed which the all-inclusive training fees do not cater for as the vet need is an unknown factor, like wise if there is a surplus in the amount of monies charged to the bills paid that shall also be split between the owners dependant on percentage shares owned.
  7. Harlequin Management Fees Harlequin Racing will manage the syndicate as well as the Horses career. Included in this will be a welcome pack to the owners including a photo of the Horse and your share certificate of ownership. The management fee charged by Harlequin will be £5,000 per year per Horse. All syndicated Horses will have their own web space on the syndicate website and all horses will have a weekly update via the website or via the what’s app group. Harlequin will manage all the financial transactions between the owners and the trainers in concern of stable fee bills and prize money. Harlequin shall arrange stable visits and other membership benefits from the management fees charged.
  8. Prize Money As the owner of the Horse you will be entitled to your owners % share of the prize money won or the run money received by your horse. The Stable bills will have all the details of incoming funds as well as the outgoing costs for the horse. The Harlequin Management fee will be added monthly to your stable bill or will be included in the all in training fees.
  9. Syndicate Set Up As the owner you enter a 1-year syndicate with the termination date clearly on the website of each horse. You own your share of the horse for life. The syndicates reform the same day the syndicates end. There is the initial purchase price to buy your horse and each year after that you only pay your monthly fees. As the owner at the point the syndicate reforms you can either ask to terminate your share or you can move forward to the next year. If there is a need for a vote or for a ballot at any time this will be based on your shareholding. If you own 1 share you get 1 vote or 1 entry to the ballot. 2 shares 2 votes and 2 entry’s and so on. If the horse wins silverware this will be drawn by ballot by the trainer or their representative on the day. Harlequin Management shall ensure the winning ballot member receives the silverware. If there is a hung vote Harlequin will have the casting vote.
  10. Racing Silks Each horse shall race in the silks of Harlequin Syndicates. The cost of silks will be added to the horse’s initial costs and if the need arises that extra silks are needed the cost shall be added to the relevant months bill.
  11. Sponsorship and VAT If we receive any VAT refunds or Sponsorship money this will be deducted from the monthly stable fee costs.
  12. Racing Costs There will be costs involved in getting the horse to the track and jockey fees to pay, this money will be on the monthly stable bill as and when we are charged the fees from the trainer and from the jockey club. Racing fees are not included in the stable fees and any surplus funds from racing will be divided up to the owners at each syndicates year end or when the sum of money is worth splitting..
  13. Selling of your share All shares will be first offered to the other syndicate owners. If most of the shareholders wish to sell the horse, then Harlequin Racing will achieve the best possible sale price. Each owner will be paid their share of the sale price less any costs that was incurred in making the sale. Harlequin Racing will provide this service as part of the management fees charged. If most of the syndicate wish to continue to the next year Harlequin will then advertise any shares that are wishing to be sold but you will need to continue to pay your share of the stable fees until such time a sale or an agreement with Harlequin Racing is made.
  14. There are no guarantees concerning the level of success you may experience with any Horse syndicate. Everyone’s success depends on his/her background, dedication, desire, and motivation.
